1. Design Details & Artist Disclaimer
1.1 Design Details
And She Bakes will provide a link to your design details via email with your order invoice. It is your responsibility to review these details thoroughly and request changes or raise concerns before making payment.
By making payment, you confirm that all design details are correct. If errors (e.g., misspelled names) are not identified and communicated prior to payment, And She Bakes will assume the details are accurate and will not be held responsible for these errors. Please ensure the design details accurately reflect your preferences, as And She Bakes will follow them exactly to complete your order.
Changes to design details after payment may be accommodated if communicated promptly. However, And She Bakes cannot guarantee the requested changes, as this depends on the scope of the changes and the timeframe provided. All accepted changes must be confirmed with written approval from both parties.
And She Bakes is not responsible for design details or specifications that were not communicated by you and, further, not listed in the design details.
1.2 Artist Disclaimer
By placing an order with And She Bakes, you agree to allow creative freedom in executing your design. While the design details will be followed, they will be interpreted through the lens of And She Bakes' style and artistry.
1.2.1 Inspiration Photos
And She Bakes' artistic style and skill set may differ from those of the artists featured in your inspiration photos. To respect the originality of others' work and And She Bakes' artistry, exact replication of inspiration photos is not offered.
If there are specific elements from an inspiration photo that you want included, you must communicate this explicitly to And She Bakes. Without such communication, no specific design element from your inspiration photos is guaranteed to appear in the final design.
1.2.2 Replicating Past Work
And She Bakes does not create exact replicas of past custom orders. Instead, designs will capture the essence and vibe of previous work while maintaining originality and freshness.
If there is a specific element from a past design that you want incorporated, you must communicate this explicitly to And She Bakes. Without such communication, no specific design element from past orders is guaranteed to appear in your final design.
2. Sourced Materials:
Orders requiring specially sourced materials are subject to availability and shipping timelines, which may be affected by the timeframe of your order or issues beyond And She Bakes' control.
If these materials do not arrive in time, And She Bakes will not be held responsible and will not issue a refund for the cost of these materials. In such cases, And She Bakes will still complete your order using a modified design and will communicate with you to finalize the adjustments for approval.
If the materials do not arrive and you choose to cancel your order instead, your cancellation will be subject to And She Bakes' cancellation policy outlined below.
3. Payment:
Full payment is due by the deadline listed on your invoice. Failure to pay or communicate requested design changes by this deadline will result in the cancellation of your order, and the date will be made available to other clients, including those on the waitlist.
A 9.75% Tennessee sales tax will be applied to all orders.
By making payment, you confirm that you have read, understood, and agreed to these terms and conditions.
4. Cancellations, Refunds & Rescheduling
4.1 Cancellations & Refunds
Orders canceled 7 or more calendar days before the scheduled pickup/delivery date are eligible for a full refund.
Orders canceled within 7 calendar days of the scheduled pickup/delivery date will receive a 50% refund.
Orders canceled within 3 calendar days of the scheduled pickup/delivery date are not eligible for a refund.
4.2 Rescheduling
Rescheduling is subject to And She Bakes’ availability. If the schedule is fully booked, your original pickup/delivery date and time will remain as scheduled. To inquire about rescheduling availability, please email info@andshebakesnashville.com.
A rescheduling fee may apply depending on availability and the timing of your request.
5. Pick Up & Delivery:
5.2.1 Rideshare Deliveries
And She Bakes uses rideshare services (e.g., Uber, Lyft) for deliveries.
Once an order is placed in the rideshare, And She Bakes is not responsible for any damages during transit. By selecting rideshare delivery, you accept this risk.
A $52 hold will be placed on your card to cover the rideshare cost. The difference will be refunded along with a copy of the rideshare receipt.
Rideshare details will be shared with you, but the driver will not deliver the cake to your door. You must appoint a responsible person to receive the order directly from the rideshare vehicle.
The rideshare delivery is a one-way trip. If you miss the delivery, the order will not come back to And She Bakes. In this case, your order will not be refunded or replaced.
5.2.2 Wedding Deliveries
And She Bakes offers personal deliveries for wedding cakes to ensure they arrive safely.
Delivery costs are calculated based on roundtrip mileage, time, and labor.
Please appoint a responsible person at the venue to take responsibility for the order upon delivery. And She Bakes is not liable for any damages once the cake has been delivered.
And She Bakes takes no responsibility for damages during transit caused by poor road conditions (e.g., steep hills, bumpy gravel roads). Please notify And She Bakes of any challenging road conditions in advance so precautions can be taken.
And She Bakes will deliver your cake within a 30-minute window of the scheduled delivery time.
If you miss your delivery, the cake will be returned and held for 24 hours. You may:
Schedule a pickup from And She Bakes’ location in Cane Ridge.
Schedule a re-delivery for an additional fee (subject to availability).
Re-delivery or pickup must be scheduled within And She Bakes' business hours. Visit andshebakesnashville.com/general-faq for business hours.
Missed orders not claimed within 24 hours will be forfeited without a refund.
6. Allergy Information:
6.1 General Allergens
And She Bakes products may contain the following allergens:
Milk
Wheat
Eggs
Some fillings may also contain soy.
All products are labeled with allergen information for convenience.
6.2 Nuts
While most And She Bakes products are nut-free, the kitchen is not a completely nut-free environment. Cross-contamination is possible, and And She Bakes cannot guarantee that any product is free from trace amounts of nuts. And She Bakes is not liable for any adverse reactions to its products. Please use your discretion when ordering.
Products that contain nuts are noted on And She Bakes' menu and packaging for your convenience.
6.3 Gluten-Free
And She Bakes offers gluten-free products. However, because gluten-containing products are also prepared in the same kitchen, we cannot guarantee that gluten-free items are entirely free of trace amounts of gluten. While we take precautions to minimize this risk, cross-contamination is possible, and And She Bakes is not liable for any adverse reactions. Please use your discretion when ordering.
6.4 Allergen Communication
Please communicate any allergy or dietary restrictions with And She Bakes, so we can take precautions to minimize the risk and accommodate you to the best of our ability.
7. Storage and Perishability:
Storage and serving advice is provided on And She Bakes FAQ page. And She Bakes, however, can not take responsibility for the perishability of your order once the order has been picked up, or delivered, for And She Bakes cannot control how the order is handled thereafter.
8. Damages:
Your order will be provided in pristine condition. However, And She Bakes is not responsible for any damages once the order has left our possession, as And She Bakes cannot control how the order is handled thereafter.
9. Non-Edible Decorations:
Items such as disco balls, plastic, metal or wooden dowels, cake boards, cake toppers, ribbon, fresh flowers, and similar materials are not edible and must be removed before consumption. Inedible items will be clearly noted on the product packaging and/or communicated to you for your safety. And She Bakes is not responsible for any harm caused by the consumption of inedible materials.
10. Force Majeure:
Neither Party shall be considered in default nor held responsible for any delay, interruption, or cessation of performance (excluding payment obligations) due to events beyond their reasonable control, including but not limited to earthquake, flood, fire, storm, snow, natural disaster, act of God, war, terrorism, armed conflict, labor strike, lockout, boycott, or similar events. The Party invoking this provision must:
Provide prompt written notice of the event, and
Take all reasonable steps to mitigate the effects of the force majeure event.
If a force majeure event lasts for more than 30 days in total, either Party may terminate this Agreement immediately upon written notice.
11. Copyright
All designs, logos, and photos are the property of And She Bakes and may not be published, sold, printed, or distributed without prior consent.
Designs may not be altered or damaged during styled photoshoots or published without permission.
To access photos or videos of your order, you must sign a photo release. To request a photo release, please email info@andshebakesnashville.com.
12. Privacy
Information provided to And She Bakes is private, and no data or details will be shared with any third party without your consent.
And She Bakes’ pick-up information is confidential and intended solely for the recipient of the order. Sharing any part of this information with third parties without the written consent of And She Bakes is strictly prohibited and may result in legal action.
13. Liability
If a mistake has been made that does not adhere to the order specifications (design details) agreed upon by you, And She Bakes is only liable to the amount of the cost of the specific mistake. No losses beyond this point.
14. Customer Satisfaction Guarantee
And She Bakes promises to make your order according to the requirements provided on the design details.
Subjective complaints with regard to the taste or quality of the cake will not be accepted, and no refunds will be made in this regard.
15. TN Freedom Food Act:
And She Bakes is a home bakery, legally operating under TN Food Freedom Act.
